1. Acceptance of Terms

By accessing and using GAIN OPTIMIZER (the "Service"), you agree to be bound by these Terms of Service. If you do not accept these terms in their entirety, you should not use the Service.

These terms constitute a legally binding agreement between you ("the User") and GAIN OPTIMIZER ("we", "our", "us").

2. Service Description

GAIN OPTIMIZER is an advanced trading indicator designed for TradingView and MetaTrader 5 platforms. The Service provides:

• Buy and sell signals based on technical analysis
• Trend detection system via Range Filter
• Six customizable visual themes
• Automated market analysis tools
• Integrated risk management system

3. License to Use

3.1 Grant of License

We grant you a limited, non-exclusive, non-transferable, and revocable license to use the Service in accordance with these terms.

3.2 Restrictions

You are not authorized to:

• Copy, modify, distribute, or sell the Service's source code
• Reverse engineer or decompile the software
• Share your license with other users
• Use the Service to create competing products
• Remove or modify copyright notices
• Use the Service for illegal or unauthorized purposes

3.3 Personal Use

The license is strictly personal and tied to a specific TradingView or MetaTrader account. Any commercial use or redistribution requires a separate commercial license.

4. Subscription and Payment

4.1 Subscription Plans

The Service offers several subscription plans:

• Monthly: €49/month, automatically renewed
• Quarterly: €135/quarter (8% savings)
• Annual: €500/year (15% savings)

4.2 Automatic Renewal

Your subscription will automatically renew at the end of each period unless canceled beforehand. The amount will be charged to your registered payment method.

4.3 Payment Methods

We accept credit/debit cards, PayPal, and bank transfers. All transactions are secure and encrypted.

4.4 Cancellation

You can cancel your subscription at any time from your dashboard. Cancellation will take effect at the end of the current billing period, with no prorated refund.

5. Trial Period

We offer a 7-day free trial for new users. During this period:

• You have access to all features of the monthly plan
• No payment is required to activate the trial
• You can cancel at any time without charges
• If you don't cancel before the trial ends, your monthly subscription will automatically begin

Each user can only benefit from the free trial period once.

6. Risk Warnings

By using GAIN OPTIMIZER, you acknowledge and accept that:

• Risk of Loss: Trading financial products can result in significant losses, potentially exceeding your initial investment
• No Guarantee: Past performance does not guarantee future results. No trading system can guarantee profits
• Volatility: Financial markets are volatile and unpredictable. Conditions can change rapidly
• Technical Risk: Technical failures, connection errors, or bugs may affect performance
• Personal Responsibility: You are solely responsible for your trading decisions and their financial consequences

7. User Responsibilities

As a user, you agree to:

• Provide accurate and up-to-date information during registration
• Maintain the confidentiality of your login credentials
• Immediately inform us of any unauthorized use of your account
• Comply with all applicable laws and regulations in your jurisdiction
• Use the Service in accordance with these terms
• Not attempt to bypass security mechanisms or licensing

8. Intellectual Property

All intellectual property rights related to the Service, including but not limited to:

• Source code and algorithms
• Logos, trademarks, and trade names
• Documentation and user guides
• Designs and graphical interfaces
• Trading strategies and methodologies

remain the exclusive property of GAIN OPTIMIZER. No provision of these terms transfers these rights to you.

9. Limitation of Liability

9.1 Disclaimer of Warranties

The Service is provided "as is" and "as available", without warranty of any kind, express or implied, including but not limited to:

• Warranty of merchantability
• Fitness for a particular purpose
• Non-infringement of rights
• Accuracy or reliability of signals

9.2 Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for:

• Any financial loss resulting from use of the Service
• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Service interruptions or technical errors
• Trading decisions based on provided signals

Our total liability shall in no case exceed the amount you paid during the last 12 months.

9.3 Indemnification

You agree to indemnify and hold harmless GAIN OPTIMIZER, its officers, employees, and partners against any claims arising from your use of the Service or violation of these terms.

10. Termination

10.1 Termination by User

You can terminate your account at any time by:

• Canceling your subscription from your dashboard
• Contacting our customer service

Termination will take effect at the end of the current billing period.

10.2 Termination by GAIN OPTIMIZER

We reserve the right to suspend or terminate your access immediately, without notice or refund, in case of:

• Violation of these terms
• Fraud or attempted fraud
• Non-payment of subscription fees
• Abusive or harmful use of the Service
• Illegal or suspected illegal activity

10.3 Effects of Termination

Upon termination of your account:

• Your access to the Service will be immediately revoked
• All granted licenses will be terminated
• Your data may be deleted in accordance with our privacy policy
• Clauses that, by their nature, should survive termination will remain in effect

11. Modifications

11.1 Service Modifications

We reserve the right to modify, suspend, or discontinue all or part of the Service at any time, with or without notice.

11.2 Terms Modifications

We may update these terms at any time. In case of substantial modification:

• We will inform you by email and/or via a notification in the Service
• New terms will take effect 30 days after notification
• Your continued use of the Service after this period constitutes acceptance of new terms
• If you don't accept the modifications, you can terminate your subscription

11.3 Pricing Modifications

We reserve the right to modify our pricing. New prices will apply:

• Immediately for new subscribers
• At the next renewal for existing subscribers
• With at least 30 days notice
